User Agreement

1. Acceptance of Terms

By creating an account, making a purchase, or otherwise accessing the Services, you confirm that you are at least 18 years old (or the age of majority in your jurisdiction), that you have read and understood this Agreement, and that you have the legal authority to enter into this Agreement on behalf of yourself or your organization.

2. Account Registration

2.1 Account Creation

To access certain features, you must create an account. You agree to provide accurate, complete, and current information during registration and to keep your information up to date.

2.2 Account Security

You are responsible for maintaining the confidentiality of your account credentials. You agree to notify us immediately at support@aquapulse.com if you suspect unauthorized access to your account. Bio-Pure is not liable for any loss resulting from unauthorized use of your account.

2.3 Account Termination

We reserve the right to suspend or terminate your account at our sole discretion if you violate this Agreement or engage in conduct we determine to be harmful to other users, the Services, or Bio-Pure.

3. Products and Purchases

3.1 Product Descriptions

We make every effort to accurately describe our products, including AquaPulse water treatments, biological products, equipment, and digital tools. However, we do not warrant that product descriptions, pricing, or other content is error-free, complete, or current. We reserve the right to correct errors and update information at any time.

3.2 Pricing and Payment

All prices are listed in U.S. dollars unless otherwise stated. Prices are subject to change without notice. You agree to pay all charges at the prices listed at the time of your order. Payment must be made through our approved payment methods. Orders are not confirmed until payment is processed successfully.

3.3 Taxes

You are responsible for all applicable taxes associated with your purchase. We will collect and remit taxes as required by applicable law.

3.4 Order Cancellations

We reserve the right to cancel or refuse any order at our sole discretion, including for reasons such as product unavailability, errors in pricing, or suspected fraud. If we cancel an order after payment, we will issue a full refund to your original payment method.

4. Shipping and Delivery

• Orders are processed within 1–3 business days of payment confirmation
• Estimated delivery times are provided as a courtesy and are not guaranteed
• Risk of loss and title for products pass to you upon delivery to the carrier
• We are not responsible for delays caused by the carrier, weather, customs, or other circumstances beyond our control
• For international orders, you are responsible for all customs duties, import taxes, and compliance with local regulations

5. Returns, Refunds, and Exchanges

5.1 Return Policy

Unopened physical products may be returned within 30 days of delivery for a full refund, minus shipping costs. To initiate a return, contact support@aquapulse.com with your order number.

5.2 Defective or Damaged Products

If you receive a defective or damaged product, contact us within 7 days of delivery with photos and your order number. We will arrange a replacement or full refund at no additional cost to you.

5.3 Digital Products

Digital products, subscriptions, and downloadable content are non-refundable once accessed or downloaded, except where required by applicable law.

5.4 Exclusions

Products that have been opened, used, or damaged after delivery; custom or special-order items; and products returned after the 30-day window are not eligible for return or refund except as required by law.

6. Acceptable Use

You agree to use the Services only for lawful purposes and in accordance with this Agreement. You agree NOT to:

• Use the Services in any way that violates applicable federal, state, local, or international law or regulation
• Transmit unsolicited or unauthorized advertising or promotional material
• Impersonate Bio-Pure, its employees, other users, or any other person or entity
• Attempt to gain unauthorized access to any part of the Services or related systems
• Use automated tools (bots, scrapers, spiders) to access or collect data from the Services without our express written consent
• Upload or transmit viruses, malware, or any other malicious code
• Interfere with or disrupt the integrity or performance of the Services
• Harvest or collect other users' personal information without consent

7. Intellectual Property

7.1 Our Content

All content on the Services — including text, graphics, logos, images, audio, video, software, and the AquaPulse and Bio-Pure brand assets — is the property of Bio-Pure Products, Inc. or its licensors and is protected by copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, modify, or create derivative works without our prior written consent.

7.2 User-Generated Content

If you submit reviews, photos, forum posts, or other content to the Services ("User Content"), you grant Bio-Pure a non-exclusive, worldwide, royalty-free, sublicensable license to use, reproduce, modify, display, and distribute your User Content in connection with operating and promoting the Services.

You represent and warrant that your User Content does not infringe any third-party rights and complies with this Agreement. We reserve the right to remove any User Content at our sole discretion.

7.3 Feedback

Any feedback, suggestions, or ideas you provide to Bio-Pure regarding the Services may be used by us without any obligation to compensate you.

8. Digital Services and Subscriptions

8.1 AquaPulse App and Digital Tools

Access to premium digital features may require a paid subscription. Subscriptions automatically renew at the end of each billing period unless cancelled before the renewal date. You can manage or cancel your subscription through your account settings.

8.2 Pond Health Recommendations

Treatment recommendations, dosing calculators, and pond health guidance provided through the Services are for informational purposes only. They do not constitute professional veterinary or aquatic science advice. Results may vary based on specific pond conditions. Bio-Pure is not responsible for any adverse outcomes resulting from following recommendations provided through the Services.

8.3 Service Availability

We do not guarantee that the Services will be available at all times. We may suspend, modify, or discontinue any part of the Services at any time with or without notice. We are not liable for any loss or inconvenience resulting from downtime or discontinuation.

9. Disclaimer of Warranties

THE SERVICES AND ALL PRODUCTS ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

BIO-PURE DOES NOT WARRANT THAT (A) THE SERVICES WILL BE UNINTERRUPTED OR ERROR-FREE; (B) ANY DEFECTS WILL BE CORRECTED; OR (C) THE SERVICES ARE FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

10. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, BIO-PURE PRODUCTS, INC. AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND LICENSORS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR IN CONNECTION WITH:

• Your use of or inability to use the Services
• Any product purchased through the Services
• Unauthorized access to or alteration of your data
• Any other matter relating to the Services

IN NO EVENT SHALL BIO-PURE'S AGGREGATE LIABILITY TO YOU EXCEED THE GREATER OF (A) THE AMOUNT PAID BY YOU TO BIO-PURE IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM OR (B) ONE HUNDRED DOLLARS ($100).

11. Indemnification

You agree to defend, indemnify, and hold harmless Bio-Pure Products, Inc. and its officers, directors, employees, contractors, agents, licensors, and service providers from and against any claims, liabilities, damages, judgments, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or relating to your violation of this Agreement, your use of the Services, or your User Content.

12. Governing Law and Dispute Resolution

12.1 Governing Law

This Agreement is governed by and construed in accordance with the laws of the State of [State], without regard to its conflict of law provisions.

12.2 Arbitration

Any dispute, claim, or controversy arising out of or relating to this Agreement or the Services shall be resolved by binding arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules. The arbitration shall take place in [City, State]. The arbitrator's decision shall be final and binding.

12.3 Class Action Waiver

YOU AGREE THAT ANY DISPUTE RESOLUTION PROCEEDINGS WILL BE CONDUCTED ONLY ON AN INDIVIDUAL BASIS AND NOT IN A CLASS, CONSOLIDATED, OR REPRESENTATIVE ACTION. IF FOR ANY REASON A CLAIM PROCEEDS IN COURT RATHER THAN ARBITRATION, YOU WAIVE YOUR RIGHT TO A JURY TRIAL.

12.4 Exceptions

Notwithstanding the above, either party may seek injunctive or other equitable relief in any court of competent jurisdiction to prevent irreparable harm, including to protect intellectual property rights.

13. Changes to This Agreement

We may update this Agreement from time to time. We will notify you of material changes by posting the revised Agreement with an updated "Last Updated" date and, where appropriate, by sending an email notification. Your continued use of the Services after the effective date of any changes constitutes your acceptance of the revised Agreement.

14. General Provisions

• Entire Agreement: This Agreement and our Privacy Policy constitute the entire agreement between you and Bio-Pure regarding the Services and supersede all prior agreements.
• Severability: If any provision of this Agreement is found to be unenforceable, the remaining provisions will continue in full force and effect.
• Waiver: Our failure to enforce any right or provision of this Agreement will not be deemed a waiver of such right or provision.
• Assignment: You may not assign or transfer your rights under this Agreement without our prior written consent. We may assign this Agreement without restriction.
• Force Majeure: We are not liable for delays or failures in performance resulting from causes beyond our reasonable control.
